Collections and Creditor Harassment

We Stop Harassing Collections Calls in Arizona

Under the laws of the Fair Debt Collections Practices Act (FDCPA), creditors and independent collection agencies are under restrictions regarding their practices. If you are being harassed with threatening telephone calls, letters, and personal visits, Clark Law Offices can help. We are a debt relief agency that offers a complete range of bankruptcy and debt settlement practices that can stop harassing collections practices immediately.

What is creditor harassment and what are creditors allowed to do?

Under the rules of the Fair Credit Collections Act, debt collectors are required to treat you fairly and with respect. Unfortunately, the word respect often means many things to different creditors. The law does not say that you don't owe money you legally borrowed. The FDCPA covers collections efforts for consumer debt such as credit card debt, and all personal and family debts.

By regulation, debt collectors:

  • May contact you in person, by telephone, or by fax
  • May be prohibited from contacting you before 8:00 AM or after 9:00 PM
  • May not contact you at work, if you employer disapproves
  • Must stop contacting you if you write a letter telling them to stop
  • Must contact only your attorney if you have retained a lawyer
  • Must tell you what debt they are collecting on, and the amount to be collected
  • May not use threats of violence, loss of employment, or loss of security
